These Terms of Service ("Terms") apply to your use of Comet and the services available through cometwebsitebuilder.com. By creating an account or using Comet, you agree to these Terms.

1. What Comet provides
Comet is a website-building platform that allows users to create, manage and publish websites using our tools and features. Depending on the features available on your account, Comet may also allow you to:
- upload images, videos and other content;
- connect a custom domain;
- add forms or interactive features;
- integrate third-party services;
- sell products or connect commerce services;
- use templates and design tools; and
- manage your website through your Comet account.
We may add, improve, change or discontinue features as Comet develops. Where a change materially affects a paid service, we will aim to give reasonable notice where practicable.
2. Your account
You must provide accurate information when creating an account. You are responsible for maintaining the security of your login details and for activity carried out through your account. Please contact us promptly at [email protected] if you believe somebody has accessed your account without permission.
You must be at least 18 years old, or otherwise legally able to enter into a contract in your country, to purchase a paid Comet subscription.
3. Subscriptions and payment
Some Comet services require a paid subscription. The price, billing period and features included in your subscription will be shown before you purchase. Unless otherwise stated, paid subscriptions renew automatically at the end of each billing period until cancelled.
Payments are processed by our payment provider. Comet does not store complete payment card details.
We may change our subscription prices in the future. If a change affects an existing subscription, we will provide reasonable advance notice before the new price applies.
4. Cancelling your subscription
You can cancel your subscription through your Comet account or by contacting us at [email protected]. Unless otherwise stated at the time of purchase, cancellation stops future renewal payments and your paid service will continue until the end of the billing period you have already paid for.
Cancelling a subscription does not automatically delete your Comet account or website unless you choose to delete them separately. Nothing in these Terms limits any cancellation, refund or other rights you have under applicable consumer law. Full details on cancellations, refunds and what happens to a downgraded website are set out in our Refund and Cancellation Policy.
5. Consumer rights
If you use Comet as a consumer, you may have legal rights that apply in addition to these Terms. Nothing in these Terms excludes or restricts any consumer rights that cannot legally be excluded. Where applicable, information about cancellation rights will be provided during the purchase process.
6. Your content
You retain ownership of the photographs, text, artwork, videos, designs and other material that you upload to Comet ("Your Content"). You give Comet a limited, non-exclusive licence to host, store, reproduce, process and display Your Content only as necessary to provide and operate the Comet service. This licence ends when Your Content is deleted from our systems, subject to reasonable backup, security and legal retention periods.
You are responsible for ensuring you have the necessary rights and permissions to use and publish Your Content. Comet does not claim ownership of websites or creative material produced by its users.
7. Content belonging to other people
You must not upload or publish material that infringes another person's copyright, trade mark, privacy rights or other legal rights. If we receive a credible report that content may infringe another person's rights, we may investigate and may temporarily restrict or remove that content where appropriate.
8. Acceptable use
Your use of Comet is also subject to our Acceptable Use Policy. You must not use Comet to operate websites or distribute content that is unlawful, fraudulent, seriously harmful, abusive, malicious or otherwise prohibited by that policy.
Each plan includes video playback on your published websites for normal use. Video viewing is subject to fair use: if a website's videos are watched far more than is typical for its plan, we will contact you to discuss options, such as moving to a plan that suits the traffic or hosting the video elsewhere. We will not restrict video playback for this reason without first contacting you and giving you a reasonable opportunity to respond.
9. Domains
Comet may allow you to connect a domain name that you have obtained from a third-party domain provider. Unless we expressly state otherwise, you are responsible for:
- purchasing and renewing your domain;
- keeping your domain registration information accurate;
- paying domain-provider fees; and
- maintaining control of your domain.
Comet is not responsible for the loss or expiry of a domain caused by your domain provider or a failure to renew it.
10. Third-party services
Comet may connect with third-party services such as payment processors, print-on-demand providers, analytics providers, domain providers or other integrations. Those services may have their own terms and privacy policies. We are not responsible for a third-party service solely because it can be accessed through or connected to Comet. We may change or remove an integration if a third-party provider changes, restricts or discontinues its service.
11. Website visitors and customer data
If you use Comet to collect information from visitors to your own website, you are responsible for ensuring that your use of that information complies with applicable privacy and data-protection laws. This may include providing your own privacy notice and obtaining appropriate consent where required. Where Comet processes personal information on your behalf, additional data-processing terms may apply.
12. Suspension
We may temporarily suspend or restrict an account or website where we reasonably believe this is necessary to:
- protect the security or reliability of Comet;
- investigate suspected fraud or unlawful activity;
- address a serious breach of these Terms or our Acceptable Use Policy;
- respond to a valid legal requirement;
- protect users or third parties from harm; or
- address overdue payments relating to a paid service.
Where appropriate, we will try to explain the reason and give you an opportunity to resolve the issue. In urgent situations, we may act without advance notice.
13. Closing an account
You may close your Comet account through the available account controls or by contacting us. After an account is closed, websites associated with the account may no longer be publicly available. We will delete or anonymise account information in accordance with our Privacy Policy, except where we are required or reasonably permitted to retain information for legal, security, accounting or dispute-resolution purposes.
14. Availability
We work to keep Comet available and reliable, but no online service can guarantee uninterrupted availability. From time to time, Comet may be unavailable because of maintenance, updates, technical issues or circumstances outside our reasonable control. We will take reasonable care in providing the service.
15. Backups and important content
Our database provider keeps daily backups of the Comet service database for a short period, which we may use to recover the service as a whole. We cannot promise to restore an individual website, and uploaded images, videos and published website files are not separately backed up. You should keep your own copies of important original files, and you can download a complete copy of your website at any time using the export option in the editor.
16. Comet intellectual property
Comet's software, branding, interface, templates, graphics and other materials created by us are owned by or licensed to Comet. Using Comet does not transfer ownership of those materials to you. You may use Comet's tools and templates as part of websites created through the service, subject to these Terms. You must not copy, resell, reverse engineer or exploit the Comet platform itself except where the law expressly permits it.
17. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. If you are a consumer, nothing in these Terms affects your statutory rights.
To the extent permitted by law, Comet is not responsible for losses that were not reasonably foreseeable when you entered into these Terms, or for business losses where you use Comet wholly as a consumer. If you use Comet for business purposes, additional reasonable limitations of liability may apply as permitted by law.
18. Changes to these Terms
We may update these Terms as Comet develops or where changes are required for legal, regulatory, security or operational reasons. If a change materially affects your rights or a paid subscription, we will provide reasonable notice where appropriate.
19. Governing law
These Terms are governed by the laws of Scotland. If you are a consumer, you may also benefit from mandatory protections available under the law of the country where you live.
